TERMS AND CONDITIONS OF SERVICES

You desire to participate in Reiki meditation services (the "Services") provided by Analina Garcia (d/b/a Hug a Tree Reiki) (“Hug a Tree Reiki”). In consideration of receiving such Services, you acknowledge and agree to all the terms and conditions set forth below:

• Reiki is a simple, gentle, hands-on energy technique and can be performed in-person or remotely.

• For best results, it is recommended that you use headphones, be in a quiet space, and lay on something comfortable during your remote session.

• Sessions are 60 minutes in length and take place remote (via Zoom) or in-person. Sessions will begin and end promptly at the scheduled time. All scheduling by Hug a Tree Reiki is done in Pacific Standard Time. It is your responsibility to confirm that the scheduled time works for you if you are in a different time zone.

• If your session is being held remotely (via Zoom), it is your sole responsibility to ensure that you have adequate technology hardware, equipment, software, and the internet access necessary to participate in the session. Hug a Tree Reiki bears no responsibility in the event that you are unable to participate in your scheduled session due to technical issues, and any failure to attend your scheduled session due to technical issues will be subject to our Cancellation Policy below.

• It is your sole responsibility to ensure that the contact information provided to Hug a Tree Reiki (name, email address, and phone number) are correct. Hug a Tree Reiki shall not be responsible if you are unable to participate in your scheduled session due to incorrect contact information provided by you. You are solely responsible to provide any updated contact information in the event of any changes.

By participating in a session with Hug a Tree Reiki, you agree that you have read, understand and agree to the following:

o You understand that Reiki services are not medical services and are not a substitute for medical or psychological diagnosis and treatment.

o You understand that Analina Garcia is not a licensed medical professional, does not diagnose conditions, nor does she prescribe or perform medical treatment, prescribe substances, or interfere with the treatment of a licensed medical professional.

o You understand that it is your responsibility to consult with a physician or other necessary medical providers prior to any Reiki session.

o You confirm that you are in good health, proper physical condition and do not have any medical or other conditions that would impair your ability to participate in the Services.

o You understand and agree not to participate in Reiki sessions while under the influence of drugs, alcohol, or any other substance.

o You understand and agree that all sessions are prepaid and only secured upon payment.

o You understand and agree to the terms of the Cancellation Policy below and understand and agree that it is your full responsibility to cancel or reschedule your appointment pursuant to the terms of the Cancellation Policy. You understand that your session(s) may not be fully refundable, or refundable at all, depending on the type of session you booked and/or when the session(s) is/are canceled or rescheduled.

o You understand and agree to the terms of the Release and Waiver below.

o Privacy Notice: No information about you or the Services provided to you will be discussed or shared with any third-party without your written consent.

CANCELLATION POLICY

Single Sessions

Single sessions may be cancelled for a full refund with 24 hours’ advanced notice. Cancellations made with less than 24 hours’ notice (including no shows), are non-refundable.

Package Sessions

Sessions purchased as part of a discounted session package may be rescheduled or eligible for partial reimbursement subject to the following:

• Cancellations of sessions purchased as part of a discount session package made with less than 24 hours’ notice (including no shows), are non-refundable.

• For cancellations of sessions purchased as part of a package that are made at least 24 hours prior to a session, credit for such unused session may be applied to future sessions and/or may be transferred to someone else by providing the recipients full name, email, cell phone, their replied confirmation and acknowledgement and agreement to the Terms and Conditions of Services, including the Cancellation Policy and the Release and Waiver, to Hugatreereiki@gmail.com.

• All sessions purchased as part of a discounted session package must be used (by you or any person to whom you wish to transfer the session to) within 12 months of the original purchase date and will automatically expire upon the 12-month anniversary of the purchase date of such package. Transferring a session to another person does not restart the 12-month period to use the sessions included in the package. Any reimbursement for unused sessions shall be subject to a $50 administrative fee and reimbursement pursuant to the following schedule:

Number of Unused Sessions: 1

Remaining at the End of 12-Month Period Reimbursement: $37 reimbursement (For example, you paid $285, received $198 worth of Reiki services (i.e., two sessions), and were charged a $50 administrative fee)

Number of Unused Sessions: 2

Remaining at the End of 12-Month Period Reimbursement: $136 reimbursement (For example, you paid $285, received $99 worth of Reiki services (i.e., one session), and were charged a $50 administrative fee)

Number of Unused Sessions: 3

Remaining at the End of 12-Month Period Reimbursement: $235 reimbursement (For example, you paid $285, received $0 worth of Reiki services (i.e., zero sessions), and were charged a $50 administrative fee)

RELEASE AND WAIVER

• YOU AGREE TO ACCEPT AND ASSUME ALL RISKS OF ILLNESS, PERSONAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, TEMPORARY OR PERMANENT DISABILITY, DEATH, PROPERTY DAMAGE, AND/OR FINANCIAL LOSS ARISING FROM THE SERVICES, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF HUG A TREE REIKI OR OTHERWISE.

• You expressly waive and release any and all claims, now known or hereafter known, against Analina Garcia, Hug a Tree Reiki, and any of its officers, directors, managers, employees, agents, affiliates, shareholders/members, successors, and assigns (collectively, "Releasees") on account of personal or psychological injury, illness, pain, temporary or permanent suffering, disability, death, property damage, or financial loss arising out of or attributable to my receipt of the Services, whether arising out of the ordinary negligence of Hug a Tree Reiki or any Releasees or otherwise. You covenant not to make or bring any such claim against Analina Garcia or Hug a Tree Reiki or any other Releasee, and forever release and discharge the Releasees from liability under such claims.

• You understand that by signing this release, you are waiving any and all claims of any kind arising out of or attributable to my receipt of the Services, including those claims that may be unknown to you, or which you do not suspect to exist at this time. WITH THE INTENTION OF WAIVING ALL UNKNOWN AND UNSUSPECTED CLAIMS, YOU EXPRESSLY WAIVE ALL RIGHTS, BENEFITS, AND PROTECTIONS YOU MAY HAVE UNDER CALIFORNIA CIVIL CODE SECTION 1542, WHICH READS AS FOLLOWS:

o A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.

• BY MAKING AN APPOINTMENT AND PROVIDING YOUR NAME AND CONTACT INFORMATION, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT YOU ARE VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE ANALINA GARCIA OR HUG A TREE REIKI OR ANY OTHER RELEASEE.

If any term or provision of the Terms and Conditions of Services, including the Cancellation Policy and the Release and Waiver, is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of the terms and conditions of services, cancellation policy and the release or invalidate or render unenforceable such term or provision in any other jurisdiction. All matters arising out of or relating to the Terms and Conditions of Services, including the Cancellation Policy and the Release and Waiver, shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction). Any claim or cause of action arising under the Terms and Conditions of Services, including the Cancellation Policy and the Release and Waiver, may be brought only in the federal and state courts located in San Bernardino County, California and you hereby consent to the exclusive jurisdiction of such courts.

YOU have read, understand, and agree to THE TERMS AND CONDITIONS OF SERVICES, INCLUDING THE CANCELLATION POLICY AND RELEASE AND WAIVER, AND AGREE TO BE BOUND BY SUCH TERMS.
